Privacy Policy

UBZ.ca (“UBZ,” “we,” “us,” or “our”) is accountable for personal information under its control. This policy explains how UBZ collects, uses, discloses, stores, transfers, and protects information when you use the UBZ mobile application, website, directory, marketplace, chat, AI-assisted search, promotions, and related services (collectively, the “Platform”). It applies subject to the privacy laws that govern you, including British Columbia’s Personal Information Protection Act and, where applicable, Canada’s Personal Information Protection and Electronic Documents Act and substantially similar provincial laws.

1. Information we collect

Account information may include your name, email address, phone number, address, password credential, profile details, verification status, language, and preferences.

Listing and marketplace information may include business or item details, seller identity, categories, descriptions, prices, location, contact information, hours, photos, videos, documents, reviews, reports, and other content you submit.

Communications and commercial records may include chat messages and attachments, support requests, reports, promotion or payment status, receipts, and consent or unsubscribe records. UBZ does not intend to receive full payment-card numbers; payment providers process card details under their own policies.

Technical information may include IP address, device and advertising identifiers where permitted, push token, operating system, app version, language, time zone, crash and diagnostic data, security logs, searches, approximate or precise location when enabled, ad-consent choices, and general usage events.

2. App permissions and location

With your permission, the app may access your camera or photo library to add images; location to search nearby or attach a place; microphone when recording supported media; tracking or advertising identifiers for advertising where legally permitted; and notifications for account, listing, safety, chat, or service updates. Permission prompts are controlled by your device. You may refuse or later change permissions in device or in-app settings, although the related feature may stop working. UBZ does not use a permission for an unrelated purpose without additional notice or consent where required.

3. How we use information

We use information only for purposes a reasonable person would consider appropriate, including to create and secure accounts; verify users; publish, search, rank, and manage listings; connect users; deliver chat, support, notifications, and AI-assisted search; process optional promotions; provide relevant advertising; measure and improve performance; prevent fraud, spam, unsafe products, and abuse; moderate content; maintain records; investigate complaints; enforce our rules; and comply with legal obligations.

Where consent is required, it must be meaningful. Optional uses are not a condition of service unless necessary for the requested feature. Commercial electronic messages are sent only with a lawful basis under Canada’s Anti-Spam Legislation and include required identification and unsubscribe options. Withdrawing consent does not affect prior lawful processing and may make a requested feature unavailable.

4. Public listing information

Information you publish in a listing is intended to be public. This can include the listing title, description, category, location, images, business details, and contact methods you choose to display. Do not publish private or sensitive information that you do not want other users to see.

5. How information may be shared

We disclose information only as reasonably necessary to: other users when you publish, communicate, or transact; vendors supporting WordPress hosting, storage, authentication, email, chat, moderation, diagnostics, maps, and customer support; Expo and Google/Firebase for app and push-notification delivery; Google AdMob and consent services for advertising subject to your choices; Stripe, Apple, Google, or another displayed provider for payments or sign-in; and Anthropic when AI-assisted search is enabled. AI search sends the search wording and necessary taxonomy context, not full account or listing records, unless the feature clearly states otherwise.

UBZ requires third-party providers that receive personal data to maintain the same or equal protection described in this policy and required by applicable law. They may receive device, transaction, or usage information needed for their service. We may also disclose information with consent; to comply with a subpoena, court order, regulator, law-enforcement request, product-safety request, or other lawful process; to investigate fraud, security, rights violations, or emergencies; to establish or defend legal claims; or as part of a proposed or completed financing, merger, reorganization, or asset transfer, subject to appropriate protections.

6. Third-party services

The Platform may contain third-party websites, advertisements, payment pages, maps, social profiles, app-store services, and integrations. Their collection and use are governed by their policies, not this policy. Review those policies before providing information. UBZ does not control third-party sellers, websites, advertisers, payment providers, map services, social networks, Apple, Google, Stripe, Expo, Anthropic, or the goods and services users advertise.

7. Storage, retention, and transfers

We retain information only while reasonably necessary for the identified purpose or for legitimate legal, tax, accounting, fraud-prevention, safety, backup, enforcement, and dispute records. Retention varies by record. Public listings may remain cached or archived for a limited period after deletion; transaction, consent, complaint, safety, and security records may be kept longer where required or reasonably necessary. We delete or de-identify information when retention is no longer justified.

Information may be processed in Canada, the United States, or other countries where providers operate and may be accessible to courts, law enforcement, or regulators under local law. We use contractual, organizational, and technical measures appropriate to the sensitivity of the information, but cannot promise that foreign laws provide identical protection.

8. Security

UBZ uses safeguards appropriate to the sensitivity of information, which may include encrypted transmission, access controls, authentication, provider restrictions, backups, logging, updates, and protected infrastructure. No internet, mobile, email, or storage system is completely secure, and UBZ cannot guarantee that unauthorized access, loss, misuse, or interruption will never occur. Keep credentials confidential, use device security, avoid sending sensitive financial or identity information through listings or chat, and notify us promptly of suspected misuse.

We assess suspected privacy and security incidents and will notify affected individuals and report to privacy regulators when required, including where a breach creates a real risk of significant harm under applicable law. We may preserve records needed to investigate and meet reporting duties.

9. Your privacy choices

You may update account and listing information in the app and request access to, correction of, or deletion of personal information under our control. You may also ask how it has been used and disclosed, withdraw optional consent on reasonable notice, change device permissions and ad choices, unsubscribe from commercial messages, close an account, or challenge our compliance. We may verify identity, separate another person’s information, charge only a fee permitted by law, and retain or refuse information where law requires or permits. Some public or cached content may not disappear immediately.

If your concern remains unresolved, you may contact the Office of the Information and Privacy Commissioner for British Columbia or, where applicable, the Office of the Privacy Commissioner of Canada.

10. Children’s privacy

Accounts and marketplace transactions are intended only for people who have reached the age of majority where they live and who are at least 18 years old. UBZ does not knowingly permit anyone who does not meet this eligibility requirement to create an account. A parent or guardian who believes a minor has provided personal information should contact info@ubz.ca. We may verify the request and restrict the account or delete information where appropriate and legally permitted.

11. Advertising, analytics, and tracking choices

UBZ uses Google AdMob and related consent tools to display and measure ads. Depending on your location, device settings, consent, and provider configuration, partners may use an advertising identifier, IP address, device information, app activity, approximate location, or similar technologies to select, limit, deliver, prevent fraud in, and measure advertising. Where required, personalized advertising or cross-app tracking is disabled unless you consent. You can review advertising privacy choices in Settings and device controls. Refusing personalized ads does not necessarily remove ads; it may result in contextual or less-personalized advertising. Provider opt-outs may not affect processing needed for security, frequency limits, or aggregate measurement.

12. AI-assisted search and automated tools

When you use UBZ AI-assisted search, the words you enter and limited category, location, and language context may be sent to UBZ’s server and, when enabled, Anthropic to interpret search filters. Do not enter passwords, payment-card data, government identifiers, medical details, or other sensitive information. AI output may be incomplete or wrong and is used to assist discovery, not to make legal, employment, housing, credit, medical, or other consequential decisions about you. UBZ may keep limited diagnostics to improve search, prevent misuse, and investigate errors, subject to retention limits.

13. Notifications and user communications

If enabled, we use a push token and message or listing event data to deliver notifications. Operational messages about security, accounts, transactions, moderation, or requested services may be sent where permitted even if you opt out of marketing. Users control information they send through chat. UBZ may process communications to deliver them, respond to reports, prevent spam and fraud, enforce rules, and comply with law, but does not promise to monitor every message.

14. Information about other people

If you upload or disclose another person’s image, contact details, document, message, or other personal information, you confirm you have a lawful basis and any consent needed to do so. Do not post identity documents, private addresses, children’s information, or confidential records unless strictly necessary, expressly requested by UBZ through a secure feature, and lawful. UBZ may remove or restrict improperly disclosed information.

15. De-identified and aggregate information

We may create and use statistics or information that has been reasonably de-identified so it no longer identifies an individual, for security, analytics, service planning, category improvement, and reporting. We will not attempt to re-identify de-identified information except to test safeguards, investigate misuse, or as permitted by law.

16. Policy changes

We may update this policy when services, providers, practices, or legal obligations change. We will post the revised policy with a new effective date and provide additional notice or seek consent where required for a material new use. Continued use alone will not create consent where applicable law requires express consent.

17. Applicable law

This policy is interpreted under the privacy laws applicable to UBZ and the individual, including British Columbia and federal Canadian law where applicable. Nothing in this policy limits a non-waivable privacy or consumer right, remedy, regulator jurisdiction, or legal obligation.

This policy is available in English and intended to communicate the same substantive rules. The version and protections required by applicable law govern if an inconsistency cannot be resolved.
